Medical advertising law review of AI visibility content — what Boily checks, and what it does not
Published 2026-09-26 · Boily, Korea
AI search visibility work is, in the end, writing new hospital documents, so Korea's medical advertising law applies to it directly. Boily checks every sentence it writes or edits before publishing against a checklist based on that law, and re-checks the live page afterwards. The checklist was reviewed by a lawyer and the step is included in remediation at no extra cost. It is not legal advice and not a substitute for the official pre-review; the final judgement rests with the hospital and its lawyer.
Why review belongs in AI visibility work
An AI names a hospital because of documents. So visibility work means creating or editing procedure pages, doctor profiles and FAQs — documents a hospital publishes for patients, which can fall under the definition of medical advertising. Three things are especially risky: copy mass-produced by generative AI (the smoother it reads, the more “guaranteed” and “safest” slip in), using AI answer screenshots in marketing (readable as an endorsement claim), and sentences the hospital already had (“the best doctors”, “99% satisfaction”) carried into new pages where they become the AI's evidence.
What is checked — eight items
The items are public; how sentences are rewritten is not.
1. Guarantees and definitive claims
“100% satisfaction”, “no side effects”, “never recurs”. The most common category to creep into AI-visibility copy; rewritten as factual statements.
2. Superlatives and uniqueness
“best”, “No. 1”, “the only”, “first in Korea” — kept only with documentary evidence, otherwise removed. An AI answer screenshot does not count as evidence.
3. Comparison with or disparagement of other providers
“better than X”, “others cannot”. The same rule applies to sentences the hospital already had.
4. Patient testimonials and before/after photos
The most heavily regulated area. Not used in remediation content; flagged as review-subject where relevant.
5. Patient inducement
Discounts, events, transport reimbursement, gift certificates. Price events are never attached to procedure pages.
6. Unsupported numbers and ‘verified’
“98% satisfaction”, “proven procedure”. Not used unless traceable to HIRA, a medical society, a government notice or the hospital's official material.
7. Credentials and titles
Specialist fields, ‘specialty hospital’ designation, society certifications — official wording only. Mixing trainee / certified / board-certified is the most frequent error.
8. Sensitive expressions
Sedation and anaesthesia, non-covered pricing, equipment and brand names — never beyond the hospital's own site or public records; nothing inferred.
How — three steps
- Before writing — fix the source of every fact. Only facts traceable to the hospital's site or public records (HIRA, medical societies, government notices). Untraceable facts are not written.
- Before publishing — filter every sentence. The eight items above, sentence by sentence, across website, blog, report wording, foreign-language pages and social captions. Plastic surgery and dermatology one notch stricter.
- After publishing — compare the live page. An automated check confirms the published page matches the reviewed text and no old sentence remains. Boily fixes its own; the hospital's original sentences are flagged with alternatives.
What it is not
- · Not legal advice. The checklist was lawyer-reviewed, but each sentence's legality is finally judged by the hospital and its lawyer.
- · Not the official pre-review. Filing remains the hospital's job.
- · Not a full legal audit of the site. Boily flags what it sees within the pages it works on.
- · Not a performance device. Review is for safety; visibility and ranking are not guaranteed.
FAQ
- Q. Does an AI visibility vendor also review content for medical advertising compliance?
- A. Boily does. Every sentence it writes or edits during remediation — website pages, guides, blog posts, report wording, foreign-language pages — is checked before publishing against a checklist based on Korea's medical advertising rules, and the live page is re-checked afterwards. The checklist was reviewed by a lawyer. It is part of the service, not legal advice; the final judgement rests with the hospital and its lawyer.
- Q. Does Boily file the official pre-review on the hospital's behalf?
- A. No. Whether content is subject to pre-review and the filing itself remain the hospital's responsibility. Boily indicates which sentences are likely to be review-subject and what to remove to avoid that; it does not replace the review body.
- Q. Is the review charged separately?
- A. No. It is a built-in step of remediation with no extra fee, and there is no ‘remediation without review’ option — a risky sentence on a hospital site harms both the hospital and Boily.
- Q. Does Boily review AI-generated text?
- A. Boily does not mass-generate copy with generative AI and publish it as is. Facts come only from the hospital's site and public records, the wording is written by a person, and a person checks it before publishing. The biggest risk of auto-generated text is that plausible guarantees, superlatives and unsupported figures slip in naturally — exactly what the law prohibits.
- Q. Are plastic surgery and dermatology stricter?
- A. Yes. Before/after photos, claims of effect and price events are common there, so pre-review and wording rules weigh heaviest. Boily writes remediation content for these two specialties one notch more conservatively — procedure, precautions and facts rather than results.
Measurement first; remediation with review
Boily measures Korean hospitals biweekly on a fixed question set across four AI engines and, optionally, handles remediation. Every remediation sentence passes the checks above before it goes live. No visibility or ranking is guaranteed.
